Term And Conditions of Carriage
  1. It is the passenger’s responsibility to ensure his/her passport is valid for entry and he/she has fulfilled the immigration or other statutory requirements in the country of destination.
  2. The ferry owner and/or operator reserves the right at its absolute discretion to impose any additional charges as it may deem fit for any changes made to the ticket less than one hour prior to the departure time.
  3. The ferry owner and/or operator reserves the right at its absolute discretion to howsoever cancel or vary the services to which the ticket and/or this Term and Condition of Carriage relate in any manner with.
  4. The time(s) of departure and arrival shown in the timetable or elsewhere are not guaranteed and does not form part of the service to which this ticket and/or this Term and Condition of Carriage relate.
  5. The passengers shall ensure that all luggage, belongings, things or otherwise which the passenger may bring on board the ferry shall be free from all defects and shall be safe, duly secured and suitable for carriage on board the ferry or vessel. In addition, the passenger shall not bring on board the ferry or vessel any animals/pets, foul smelling article(s) drugs and/or firearms ammunition, gun powder, saltpeter, petroleum, diesel, kerosene or any explosives or combustible substances or any item which in the opinion of the Ferry Owner and/or operator or TOBINDO (MALAYSIA) SDN BHD (including its (successors) in title) (TMSB) are of a noxious or dangerous or hazardous nature or are undesireable or unlawful. Save for personal effects carried by hand, the passenger shall not take on board the ferry or vessel any other article(s).
  6. The passengers acknowledge that TMSB (and/or any person related to TMSB) does not own, maintain or control the ferry or vessel not to provide the service to which this ticket and/or this Term and Condition of Carriage related and is not howsoever related or TMSB to the Ferry Owner and/or operator, but is only acting as agent issuing this ticket on behalf of the Ferry Owner and/or operator.
  7. The Ferry Owner and/or Operator UEM and TMSB (and any person related or associated to TMSB),including their respective employees, officers, agent representatives shall not (whatever in contract, tort, negligence, criminal liability or otherwise be responsible or liable for any loss, damage, cost, expense or otherwise of any nature including but not limited to personal injury (fatal or non-fatal) to the passenger or loss or damage to any property or item belonging to or loss including loss of profit or any consequential damages), suffered or incurred by the passenger for any reason, whatsoever or howsoever arising at Puteri Harbour Ferry Terminal or on any ferry or vessel, or arising out of the journey to which the ticket and/or this Term and Condition of Carriage realte or for any delay, cancellation or rescheduling of the departure or arrival time(s) of any ferry or vessel, in additional to but without limiting the generality of the foregoing, the passenger hereby irrevocably :-
    • Renounces for himself, his estate, his personal representative and his dependants all responsibilities, claim and compensation (whatever in contract, tort, negligence, criminal lialibility or otherwise) against the Ferry Owner and/or Operator, UEM Sunrise and TMSB (and person related or associated to TMSB), including their respective employees, officer, agents and representatives.
    • Indemnifies and agrees to keep indemnified the Ferry Owner and/or Operator, UEM and TMSB (and any person related or associated to TMSB), including their respective employees, officers, agents and representatives, against any loss damage, cost, expense, penalty or otherwise which may be suffered by any of them in the event of any action claim, demand, investigation, proceeding or otherwise commenced by any person whomsoever against any of them directly or indirectly arising or in connection with the services to which this ticket and/or this Term and Condition of Carriage relate.
  8. A reference to ‘Ferry Owner and/or Operator’ in this Term and Condition of Carriage shall refer to the Ferry Owner and/or Operator names on the reverse side of this ticket, and if no such name appears, shall refer to the Ferry Owner and/or Operator for the time being who provides the services to which this ticket and/or Terms and Conditions of Carriage relate.
  9. Smoking to strictly prohibited in the ferry or vessel.
  10. All passengers are required to pay seaport tax at Returning Port.
Important Notice and Other Conditions
  1. The passenger is required to check-in 45 minutes before ferry departure.
  2. The passenger is advised to take note of the ferry, boarding time, and departure gate.
  3. This ticket is not transferable to a different passenger name.
  4. An Open Return ticket is valid for 3 months only from the date of issuance of ticket.
  5. Pregnant women with a maximum pregnancy of 5 months are allowed to board the ferry
  6. Pregnant women with a pregnancy of more than 5 months are not allowed to board the ferry for safety and comfort reasons.
  7. Passengers in this category are expected to provide honest information to the staff regarding their pregnancy duration.
  8. Any ticket (including an Open Return ticket) not used shall be forfeited and monies paid will not be refundable.
  9. RM 10.00 shall be charged for any changes of schedule for all confirmed tickets.
  10. The price does not include the seaport tax for departure. For departures from HarbourBay, the seaport tax is IDR 115,000.00. For departures from Puteri Harbour, the seaport tax is RM 32.00.
